A man indicted in the death of an 11-year-old in east Houston now faces a capital murder charge after appearing in court Friday.
HOUSTON — A man accused in the shooting death of an 11-year-old in east Houston faced a judge Friday as the case takes a significant turn. Prosecutors have upgraded the charge to capital murder, and the suspect’s previous charges are being dismissed.

Leon appeared in court Friday morning following a grand jury indictment earlier this week.
A judge explained that the legal focus of the case has now shifted entirely to the upgraded charge.
“Sir, that means the District Attorney’s Office is going to dismiss all the previously filed and pending felonies against you. So, you are facing only the capital murder charge one felony. Do you understand that?” the judge told Leon during the proceeding.
Prosecutors say the capital murder charge carries a possible sentence of life in prison or the death penalty.
What led up to the charge
According to investigators, the shooting happened on Racine Street in east Houston when two children were repeatedly ringing a doorbell.
Prosecutors allege Leon opened fire, striking Julian as he was running along a public sidewalk. The child later died at a hospital.
Court documents state that investigators found at least 20 firearms inside Leon’s home after the shooting.
Leon has remained in jail since the Aug. 30, 2025, incident.
Leon’s attorney pushed back on the prosecution’s claims, arguing that intent will be a central issue in the case.
“So Mr. Leon is at home with his wife and young child with somebody banging on his door multiple times throughout the night. And he comes out, and what the district attorneys are gonna wanna try and prove is that he intended to kill. The reality is I’d like to see that happened in court,” Leon’s attorney said.
The case will now move forward under the capital murder charge.
Prosecutors declined to comment on camera about the latest developments.
