The lawsuit also names two businesses the motorcyclist’s family alleges overserved alcohol to Joseph before the crash, court documents show.
RICHARDSON, Texas — Former Dallas Cowboys cornerback Kelvin Joseph Jr. is being sued by the family of a motorcyclist killed in a crash he was allegedly involved in on U.S. 75 earlier this month, according to court documents.
The lawsuit alleges wrongful death and negligence on the part of Joseph and two businesses that allegedly overserved him before the crash.
The lawsuit, filed June 18 in Dallas County, names Joseph and two businesses, Dive on 75 and The Lodge, that the victim’s family alleges overserved him before the crash. WFAA has reached out to the businesses for comment.
Police were called to the scene of the crash allegedly involving Joseph’s BMW and a motorcycle on U.S. 75 in Richardson shortly before 5 a.m. June 7, officials said. The driver of the motorcycle, Cody Morris, 27, was pronounced dead at the scene, and there was no one else around when officers arrived, police said. Officials alleged in an affidavit that Joseph drove nearly three miles from the scene of the crash before stopping, waited for nearly 40 minutes before calling 911, and did not render aid to Morris, according to an affidavit.
Joseph was ultimately arrested and charged with DWI and collision involving personal injury or death in connection with the crash and booked into the Richardson City Jail June 7 before he was released on bond the next day.
Morris’ family alleges in the new lawsuit that Joseph “was served alcoholic beverages by Defendants Dive on 75 and The Lodge to the point that he became physically intoxicated” before the crash that killed the mother of two.
“We’ve been asked to seek justice for a grieving daughter during one of the hardest moments of her life,” attorneys representing Morris’ family in the case. “There is nothing we take more seriously, and we’re fully committed to seeking answers, shining a bright light on the actions of Joseph and the places that served him alcohol on June 7, 2025, and holding them fully accountable through this civil lawsuit. We will not stop until The Morris family has answers and justice.”
Joseph admitted to drinking two glasses of wine before the crash and denied taking anything else, according to police in an affidavit.
The lawsuit seeks damages, court records show.
As WFAA previously reported, Joseph was drafted by the Cowboys in the second round of the 2021 Draft and spent two seasons with the team. He played for various teams before joining the DC Defenders in the UFL for the 2025 season.
He was previously questioned and cleared in a murder investigation that stemmed from a March 2022 shooting.
