Affidavit: Man arrested, accused of intoxication manslaughter in crash that killed 4-year-old

AUSTIN (KXAN) — A 26-year-old man was arrested after he was accused of driving while intoxicated at the time of a crash over the weekend that left a 4-year-old dead and several others injured, according to an arrest warrant affidavit.

Court records identified the man as Jonathan Dominguez. He was arrested on a charge of intoxication manslaughter.

Attorney information was not available for Dominguez, as of Wednesday. We will update this if that changes.

On June 8, APD officers responded to the 3300 block of South MoPac Expressway southbound around 1:30 a.m. for a single-vehicle crash involving an SUV, police said in a news release.

Court records said multiple 911 callers said “a silver vehicle flipped over on its roof in a ditch next to the highway.”

A preliminary investigation showed that Dominguez was the driver of the SUV, another person was in the passenger seat and four children were in the backseat, according to the affidavit. The SUV “left the roadway to the right, struck a guardrail and drove down an embankment on the right shoulder.” The SUV then landed on its roof.

When officers arrived on the scene, they found 4-year-old Johan Dominguez in the SUV. He was pronounced dead on the scene, according to police.

Court records said Jonathan Dominguez was found unconscious when police arrived. He was “immediately transported to the hospital.” Austin-Travis County EMS told police that he “became belligerent and had a heavy odor of alcohol in the ambulance.”

Jonathan Dominguez told investigators that “he had floated the river in New Braunfels and then hung out at a relative’s house” in south Austin before he said he drove home to the U.S. 183 and Burnet Road area. However, investigators said at the time of the crash, he was driving south, not north, according to the affidavit.

He told police he “was unsure of how the collision happened” and said he “blacked out,” court records said.

This is now being investigated as Austin’s 40th fatal crash of 2025, according to police.

No other details were available Wednesday.
